1. The proposed revision to the Revised Energy Supply Cost Variance Deferral Account as set out in Schedule A, with an effective date of January 1, 2021, is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

1. Hydro’s proposed construction and purchase of improvement or additions to its property in excess of $50,000 to be completed in 2021, as set out in Schedule A to this Order, are approved.
2. Hydro’s proposed multi-year proposed construction and purchase of improvement or additions to its property in excess of $50,000, as set out in Schedule B to this Order, are approved.
3. Hydro’s 2021 Capital Budget for improvements or additions to its property in an amount of $103,986,400, as set out in Schedule C to this order, is approved.

8. Unless otherwise directed by the Board Hydro shall file an annual report to the Board on its 2021 capital expenditures by March 1, 2022.
9. Unless otherwise directed by the Board Hydro shall provide, in conjunction with the 2022 Capital Budget Application, a status report on the 2021 capital budget expenditures showing for each project:
1. the approved budget for 2021;
2. the expenditures prior to 2021;
3. the 2021 expenditures to the date of application;
4. the remaining projected expenditures for 2021;
5. the variance between the projected total expenditures and the approved budget; and
6. an explanation of the variance.
10. Hydro shall pay all costs and expenses of the Board incurred in connection with the Application.

1. The amendments to the pro-forma Transmission Service Agreements, the Methodology for the Development of Rates for Transmission Service, and the NL Transmission Policies and Procedures, as filed with the Application, are approved on an interim basis.
2. The rates for transmission service, as set out in Schedule A to this Order, are approved on an interim basis, effective January 25, 2021.
3. The rates for transmission service when the Labrador-Island Link comes on-line are approved, as filed, on an interim basis, and Hydro shall file an application at least seven days before these rates are to become effective, setting out the rates and the proposed effective date of these rates.
4. Hydro shall pay the expenses of the Board incurred in connection with this matter.

1. The Power Service Agreement as set out in Schedule A to this Order is approved.
2. The Firm Energy Power Purchase Agreement as set out in Schedule B to this Order is approved.
3. The Second Amended and Restated Capacity Assistance Agreement as set out in Schedule C to this Order is approved and the reporting requirements set out in Order No. P.U. 40(2018) are continued.

3. The debit transfer of $2,476,684 to the Island Industrial Customer RSP Current Plan balance as of December 31, 2020 is approved.
4. The Island Industrial Customer one-time bill credit in the amount of $2,476,684 to be allocated by customer based on 2020 energy ratios and reflected on Island Industrial Customer bills issued in March 2021 is approved.
5. The Island Industrial Customer rates to be effective on all electrical consumption on and after February 1, 2021, as set out in Schedule A to this Order, are approved.
6. Hydro shall pay all expenses of the Board arising from the Application.

1. The Network Additions Policy for the Labrador Interconnected system, as set out in Schedule A to this Order is approved, effective April 1, 2021.
2. Hydro shall file a report on or before July 1, 2021 with respect to the feasibility of the addition of a Non-Firm Rate option to the Network Additions Policy.
3. Hydro shall file a report on or before July 1, 2023 setting out recommendations with respect to the transition to the “But For” approach as of January 1, 2024.

1. Hydro's proposal to deviate from IFRS, using IFRS 14 - Regulatory Deferral Accounts, to allow recognition of expenses related to the purchase of pre-commissioning energy in accordance with the terms of the Muskrat Falls Power Purchase Agreement is approved.

2. Hydro's multi-year construction and purchase of improvements or additions to its property in excess of $50,000 to begin in 2021 approved in Order No. P.U. 2(2021) are amended, as set out in Schedule A to this Order.
3. Hydro's 2021 Capital Budget for improvements or additions to its property approved in Order No. P.U. 2(2021) is amended, as set out in Schedule B to this Order.
4. Hydro shall pay all expenses of the Board arising from this application

1. Newfoundland Power’s proposed capital expenditures to replace its customer service system, in the amount of $9,903,000 in 2021, $15,826,000 in 2022 and $5,917,000 in 2023, are approved.
2. Newfoundland Power’s multi-year construction and purchase of improvements or additions to its property to begin in 2021 approved in Order No. P.U. 37(2020) are amended, as set out in Schedule A to this Order.

1. Newfoundland Power's Weather Normalization Reserve of a positive balance of $3,733,507 as of December 31, 2020 is approved.
2. Newfoundland Power shall pay all costs and expenses of the Board in connection with this Application.

1. The disposition of the 2020 balance in the Demand Management Incentive Account and related income tax effects by means of a debit in the amount of $1,431,126 to the Rate Stabilization Account as of March 31, 2021 is approved.

2. Hydro’s proposals for the allocation by customer class of the balances in the Revised Energy Supply Cost Variance Deferral Account, the Holyrood Conversion Rate Deferral Account and the Isolated Systems Supply Cost Variance Deferral Account for 2020 are approved.
3. Hydro’s proposal to recover the amounts allocated to Newfoundland Power and the Island Industrial customers through a transfer of balances to the respective RSP Current Plans effective March 31, 2021, with recovery from Newfoundland Power and the Island Industrial customers starting July 1, 2021 and January 1, 2022, respectively, is approved. 
4. Hydro shall pay all expenses of the Board arising from this Application.

1. Hydro’s proposal to defer and recover capital-related overhead costs beginning on January 1, 2022 through the establishment of a deferral account under IFRS 14 is accepted.
2. Hydro shall file, for approval, the proposed Capitalized Overhead Deferral Account definition, including evidence to support the proposed methodology and capitalization rate, as part of its general rate application.
3. Hydro shall pay all expenses of the Board arising from this Application.

1. The addition of a supplementary amount of $108,000 to the 2021 Allowance for Unforeseen Items is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

1. The proposed capital expenditure, estimated to be $443,000, for the overhaul of the Holyrood TGS Unit 1 Boiler Feed Pump East is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

1. The contribution of an amount equal to the final capital cost of circuit breaker replacement and associated protection for IOC-specific lines in Wabush, NL from Iron Ore Company of Canada is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

1. The proposed capital expenditure in the amount of $350,000 for the purchase of diesel generator Unit 2102 for Charlottetown, Labrador is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro in relation to Newfoundland and Labrador Hydro’s 2021 Capital Budget; and an application for costs by the communities of Sheshatshiu, Happy Valley-Goose Bay, Wabush and Labrador City.

1. The costs of the Labrador Interconnected Group are fixed at $9,866.01, exclusive of HST.
2. Hydro shall, within thirty days, pay costs to the Labrador Interconnected Group in the amount of $9,866.01.

Approval of Newfoundland and Labrador Hydro’s for approval, pursuant to sections 70(1) and 71 of the Act, of the Rate Stabilization Plan and Conservation and Demand Management Cost Recovery Rate Adjustments to be charged to Newfoundland Power Inc.

1. The proposal to use 447,114 barrels of No. 6 fuel in the calculation of the Utility Rate Stabilization Plan Fuel Rider is approved for the period of July 1, 2021 to June 30, 2022.
2. The proposed Utility rates to be effective on all electrical consumption on and after July 1, 2021, set out in Schedule A to this Order, are approved.
3. Hydro shall pay all expenses of the Board arising from the Application.

Application by Newfoundland Power Inc. pursuant to sections 70 and 71 of the Act for approval of: (i) revised rate stabilization and municipal (i) tax adjustments for the period July 1, 2021 to June 30, 2022; (ii) a revised schedule of rates, tolls and charges; and (iii) revisions to the Rate Stabilization Clause.

1. The Rate Stabilization Adjustment of 0.329 cents per kWh and the Municipal Tax Adjustment Factor of 1.02559 for the period July 1, 2021 to June 30, 2022 is approved.
2. The Schedule of Rates, Tolls and Charges as set out in Schedule A to this Order, to be effective on all electrical consumption on and after July 1, 2021, including the revised Rate Stabilization Clause, is approved.
3. Newfoundland Power shall pay the expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro for approval of a change in rates to be charged to its Island Interconnected, L'Anse au Loup and Isolated Rural customers.

1. The Schedule of Rates, Tolls and Charges as set out in Schedule A to this Order, to be effective on all electrical consumption on and after July 1, 2021, is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro for the approval of a change in the CDM Cost Recovery Adjustment to be charged to Island Industrial customers effective July 1, 2021.

1. The proposed Island Industrial customer rates, to be effective on all electrical consumption on and after July 1, 2021, as set out in Schedule A to this Order, are approved.
2. Hydro shall pay the expenses of the Board incurred in connection with this matter.

A general rate application by Newfoundland Power Inc. to establish customer electricity rates for 2022-2023.

1. The intervenors in the Application are as set out in Schedule A to this Order.
2. The Schedule of Dates for the Application shall be as set out in Schedule B to this Order and may be amended by the direction of the Board.
3. The Rules of Procedure for the Application shall be as set out in Schedule C to this Order.

Application by Newfoundland and Labrador Hydro for approval of a capital expenditure to construct an interconnection between Star Lake Terminal Station and Valentine Terminal Station to provide service to Marathon Gold Corporation pursuant to section 41 of the Act.

1. Hydro’s proposed construction of an interconnection and associated upgrades between the Star Lake Terminal Station and the Valentine Terminal Station Project mine site to allow for service to Marathon Gold Corporation, with an estimated capital cost of $3,479,300 in 2021, $12,281,700 in 2022 and $53,600 in 2023, for a total of $15,814,600, excluding HST, is approved.
2. The contribution by Marathon Gold Corporation of an amount equal to the capital cost of the work described within the Application is approved. 
3. Hydro shall pay the expenses of the Board incurred in connection with this matter.

Application by Newfoundland and Labrador Hydro for approval of a capital expenditure to purchase a diesel generating unit for the Ramea Diesel Generating Station pursuant to section 41 of the Act.

1. The proposed capital expenditure in the amount of $2,436,800 for the purchase of a diesel generator unit for the Ramea Diesel Generating Station is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

An application by Newfoundland Power Inc. for an Order pursuant to sections 41 and 78 of the Act: (a) approving a 2021 Capital Budget of $111,298,000; (b) approving certain capital expenditures related to multi-year projects commencing in 2021; and (c) fixing and determining a 2019 rate base of $1,153,556,000; and Order No. P.U. 37(2020) in relation to Newfoundland Power Inc.'s 2021 Capital Budget Application; and Order No. P.U. 12 (2021) issued on April 7, 2021 in relation to Newfoundland Power Inc.'s proposed capital expenditures to replace its customer service system, in the amount of $9,903,000 in 2021, $15,826,000 in 2022, and $5,917,000 in 2023; and an application by the Consumer Advocate, Dennis Browne, Q.C., for an order pursuant to subsections 100(3) and 118(2) of the Act staying Order No. P.U. 12 (2021).

1. The Consumer Advocate’s request for a stay pending a final determination of the Court of Appeal of Newfoundland in the Consumer Advocate’s appeal of Order No. P.U. 12(2021), is dismissed.

An application filed by Newfoundland Power Inc. on December 16, 2020 for approval of, among other things, supplemental 2021 capital expenditures related to the construction of an electric vehicle charging network associated with the implementation of new electrification programming set out in the joint utility Electrification, Conservation and Demand Management Plan 2021-2025; and an application filed by Newfoundland and Labrador Hydro June 16, 2021 for approval of, among other things, supplemental 2021 capital expenditures related to the construction of an electric vehicle charging network associated with the implementation of new electrification programming set out in the joint utility Electrification, Conservation and Demand Management Plan 2021-2025; and the application by Newfoundland Power Inc. and Newfoundland and Labrador Hydro for approval of 2021 capital expenditures for electric vehicle charging stations pursuant to section 41 of the Act.

1. Newfoundland Power Inc.’s proposed supplemental 2021 capital expenditure for the deployment of EV charging stations, in the amount of approximately $1.5 million, is approved.
2. Newfoundland and Labrador Hydro’s proposed supplemental 2021 capital expenditure for the deployment of EV charging stations, in the amount of $1.6 million, is approved.

An application filed by Newfoundland Power Inc. on December 16, 2020 for approval of, among other things, supplemental 2021 capital expenditures related to the construction of an electric vehicle charging network associated with the implementation of new electrification programming set out in the joint utility Electrification, Conservation and Demand Management Plan 2021-2025; and an application filed by Newfoundland and Labrador Hydro June 16, 2021 for approval of, among other things, supplemental 2021 capital expenditures related to the construction of an electric vehicle charging network associated with the implementation of new electrification programming set out in the joint utility Electrification, Conservation and Demand Management Plan 2021-2025; and the application by Newfoundland Power Inc. and Newfoundland and Labrador Hydro for approval of 2021 capital expenditures for electric vehicle charging stations pursuant to section 41 of the Act.

Application by Newfoundland and Labrador Hydro for approval of a Second Amended and Restated Pilot Agreement for the Optimization of Hydraulic Resources pursuant to section 3(b)(iii) of the EPCA and sections 70 and 76 of the Act.

1. The Second Amended and Restated Pilot Agreement for the Optimization of Hydraulic Resources is approved.
2. Hydro shall continue to provide updates on its Ponding and Spill Energy activities as part of its quarterly reporting to the Board during the period that the Second Amended and Restated Pilot Agreement for the Optimization of Hydraulic Resources is in effect.
3. Hydro shall file, as part of its application for approval of a final agreement for the optimization of hydraulic resources, a report summarizing its experience related to Ponding and Spill Energy activities during the pilot period as well as any measures taken to enhance the effectiveness of these activities.
4. Hydro shall pay all expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro for approval of an interruptible load service agreement with Labrador Lynx Limited.

1. The proposed Interruptible Load Service Agreement with Labrador Lynx Limited, to be effective from December 1, 2021 through to the earlier of March 31, 2022 or the in-service date of Transmission Line L1303, is approved.
2. Hydro shall pay all expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro for of new deferral accounts, changes to existing deferral accounts, and an accounting deviation, associated with the commissioning of the Muskrat Falls Project, pursuant to section 58 of the Act.

1. The proposal to establish an account to defer payments under the Muskrat Falls Project agreements, rate mitigation funding, project cost recovery from customers and supply cost variances is approved, and Hydro shall file for the approval of the Board a Supply Cost Variance Deferral Account definition reflecting the determinations of the Board in this Order, to be effective on the date upon which Hydro is required to begin payments under the Muskrat Falls Power Purchase Agreement.
2. The proposals related to the discontinuance of the Rate Stabilization Plan, the Revised Energy Supply Cost Variance Deferral Account, the Isolated Systems Supply Cost Variance Deferral Account and the Holyrood Conversion Rate Deferral Account are not approved, and Hydro shall file for the approval of the Board revised RSP Rules and Revised Energy Supply Cost Variance Deferral Account and Holyrood Conversion Rate Deferral Account definitions reflecting the determinations of the Board in this Order, to be effective on the same date that the Supply Cost Variance Deferral Account is effective.
3. The deferral of the Holyrood Thermal Generating Station accelerated depreciation expense variance beginning in 2022 is approved, and Hydro shall file for the approval of the Board a Holyrood Thermal Generating Station Accelerated Depreciation Deferral Account definition reflecting the determinations of the Board in this Order, to be effective January 1, 2022.
4. The proposed deviation from International Financial Reporting Standards to allow Hydro to recognize power purchase costs relating to the delivery of post-commissioning energy in accordance with the commercial terms of the Muskrat Falls Project agreements is approved.
5. The proposed Muskrat Falls Power Purchase Agreement Sustaining Capital Deferral Account is approved to be effective on the date upon which Hydro is required to begin payments under the Muskrat Falls Power Purchase Agreement.
6. Hydro shall pay all expenses of the Board arising from this Application.

Application by Newfoundland and Labrador Hydro for approval of a capital expenditure to supplement the 2021 Allowance for Unforeseen Items for the construction and purchase of certain improvements and additions to its property pursuant to section 41 of the Act.

1. The 2021 Allowance for Unforeseen Items is reset to $1,000,000 effective December 17, 2021.
2. Hydro shall pay all expenses of the Board arising from this Application.

An application by Newfoundland Power Inc. accordance with Order No. P.U. 4(1997-98) to update the cost factors used in its Contribution in Aid of Construction policy.

1. The revised cost factors as set out in Schedules A, B, C and D to this Order are approved to be used in the calculation of all CIACs effective from January 1, 2022 and, where advantageous to the customer, on all CIACs quoted but unpaid as of January 1, 2022.
2. Newfoundland Power shall submit a revised CIAC policy incorporating the revisions approved herein.
